Resident Rights and Responsibilities
The governing body of Sanctuary at McAuley has adopted Resident
Rights and Responsibilities, in the hope that it will contribute
to the resident’s physical and mental well being, to his/her
opportunities for continued personal growth, and to the affirmation
of his/her human dignity.
Listed below is a summary of the resident’s rights and responsibilities.

Dignity
The resident has the right to be treated with dignity. The resident
has the right to courteous, respectful and considerate treatment
from all with whom he or she comes in contact.
Freedom from Discrimination
A resident will not be denied appropriate care on the basis of race,
religion, color, national origin, sex, age, handicap, marital status,
sexual preference, or source of payment.
Access to Records
An individual who is, or has been, a resident or a person authorized
in writing by such individual shall, upon oral or written request,
be given access to all personal and clinical records pertaining
to the resident within twenty-four hours of the request.
Confidentiality
A resident is entitled to confidential treatment of personal and
medical records, and may refuse the release to a person outside
the Living Center except as required because of a transfer to another
health care Living Center or as required by law or third party payment
contract.
Privacy
A resident is entitled to privacy, to the extent feasible, in medical
treatment and in caring for personal needs with consideration, respect,
and full recognition of his or her dignity and individuality.
Care and Health Status
A resident is entitled to receive adequate and appropriate care,
and to receive, from the appropriate individual within the Living
Center, information about his or her medical condition.
Refusal of Treatment
A resident is entitled to refuse treatment to the extent provided
by law and to be informed of the consequences of that refusal.
Exercise of Rights/Presenting Grievances
A resident or a resident’s representative is entitled to exercise
his or her rights as a citizen, and to this end may present grievances
or recommend changes in policies and services on behalf of himself
or herself or others to the Living Center staff, to government officials,
or to another person of his or her choice within or outside the
Living Center.
Experimental Care and Research
A resident is entitled to information concerning an experimental
procedure as a part of his or her care and shall have the right
to refuse to participate in the experiment or research without jeopardizing
his or her continuing care.
Communication and Association
A resident is entitled to associate and have private communications
and consultations with his or her physician, attorney, or any other
person of his or her choice. The resident may also choose to refuse
to see a visitor.
Charges and Sources of Payment
A resident is entitled to receive and examine an explanation of
his or her bill regardless of the source of payment and to receive,
upon request, information relating to financial assistance available
through the Living Center.
Choice of Physician
A resident or resident representative is entitled to choose a personal
attending physician.
Freedom from Abuse and Restraint
A resident is entitled to be free from mental and physical abuse
and from physical and chemical restraints, except those restraints
authorized in writing by the attending physician for a specified
and limited time or as are necessitated by an emergency to protect
the resident from injury to self or others.
Performing Services
A resident is entitled to be free from performing services for the
Living Center that are not included for therapeutic purposes in
the plan of care.
Rules and Responsibilities
A resident is entitled to information about the Living Center rules
and regulations affecting resident care and conduct.
Planning of Care
A resident is entitled to the opportunity to participate in the
planning of his or her medical treatment, unless adjudged incompetent
or otherwise found to be incapacitated under the law of Michigan.
Financial Affairs and Personal Possessions
A resident is entitled to manage his/her own financial affairs.
Transfer and Discharge
Resident may be transferred or discharged only as provided. A nursing
home resident is entitled to be given reasonable advance notice
to ensure orderly transfer or discharge.
Non-Physician Treatment
If a resident desires treatment by a licensed member of the healing
arts, the treatment shall be made available unless it is medically
contraindicated
Resident Representative
At the time of admission or at any time thereafter, a resident shall
have the right to designate a representative to act on his or her
behalf.
Diet
Each resident shall be provided with appetizing meals which meet
the recommended dietary allowances for that resident’s age
and sex and which may be modified according to special dietary needs
or ability to chew.
Special Visitation
A resident has the right to have his/her spouse, next of kin, or
resident’s representative, stay at the Living Center 24 hours
a day if the resident is considered to have an advanced life threatening
illness by the physician responsible for the resident’s care.
Survey Information
A resident has the right to examine the results of the most recent
survey of the Living Center.
Formulation of Advance Directives
A resident has the right to formulate an advance directive with
respect to the resident’s desire to accept or refuse medical
treatment.
Pain Management
A resident is entitled to adequate and appropriate pain and symptom
management as a basic and essential element of medical treatment.
Resident Responsibilities a Resident is Responsible For
Following the Living Center rules and regulations affecting resident
care and conduct.
- Providing a complete and accurate medical history.
- Making it known whether he or she clearly comprehends a contemplated
course of action and the things he or she is expected to do.
- Following the recommendations and advice prescribed in a course
of treatment by the physician.
- Providing information about unexpected complications that arise
in the course of treatment.
- Following the Living Center’s policy regarding Human Immunodeficiency
Virus and Hepatitis B Virus testing. A Human Immunodeficiency
Virus or Hepatitis B test may be performed upon the resident without
his or her written consent if a health care worker is exposed
to the blood or other body fluids of the resident.
- Being considerate of the rights of other residents and Living
Center personnel and property.
- Providing the Living Center with accurate and timely information
concerning his or her sources of payment and ability to meet financial
obligations.
